TRANSFER TO AN ESTATE:
BML requires a copy of the Death Certificate, Letters Testamentary or other applicable documentation appointing an Estate Representative, Executor or Administrator. Also, include any change in Tax ID #. New Division Orders will be issued to the Estate, once all documentation is provided to BML. Once the Probate is finalized, BML requires a copy of the complete Probate, including the Application for Probate, the Last Will & Testament, Order Admitting the Will to Probate and Assets & Inventory Page (if available), that have been filed of record with the County Clerk’s office of the County in which the property and minerals reside, or if an Administration of an Estate, then Court documents ordering the Administration.
TRANSFER TO THE BENEFICIARIES WITH A PROBATED WILL:
Copy of the Death Certificate, the complete Probate including the Application for Probate, the Last Will & Testament, Order Admitting the Will to Probate and Assets & Inventory Page (if available), that have been filed of record with the County Clerk’s office of the County in which the property and minerals reside.
TRANSFER TO THE BENEFICIARIES WITHOUT A PROBATED WILL:
Copy of the Death Certificate and Affidavit of Heirship** that meets the Texas state requirements. The executed and notarized Affidavit of Heirship must be filed with the county clerk where the property is located.
** The Affidavit of Heirship (Click for the Texas Form) must be executed and witnessed by two disinterested parties who will not benefit from decedent’s estate. Do not complete this form if the decedent left a will that was probated in court or there was any type of court determination regarding the decedent’s estate.
Please provide the following:
- Your Name
- BML Owner Number(s) of the deceased
- BML Lease Number(s) of the deceased
- Social Security or Tax I.D. Number of the deceased
